setakat nie, puteri baca semua, dari yg pertama sampai habis...
tapi kalau yg bnyak page tue sampai ratus2 tue, tak sanggup lak nk baca hbs, puteri baca page 1-5 then skip terus 2 page yg terakir... ;D ;D ;D

mana ada time nak baca benda panjang macam tu.. ;D

PERJANJIAN sewa selama dua tahun sudah ditandatangani oleh Haji Kamal Abas bagi sebuah gerai di pusat makanan (foodcourt) di Jurong.

Tetapi kerugian yang dialaminya sehingga $5,000 sebulan disebabkan perniagaan lemah membuat beliau ingin menarik diri daripada perniagaan itu selepas hanya 10 bulan beroperasi.

Namun tanpa disedari Haji Kamal, sebelum menutup gerai itu, pemilik pusat makanan tersebut meminta beliau membayar baki $91,000 (sewa bulanan $6,500 x 14 bulan) bagi sewa 14 bulan yang belum dibayar di bawah kontrak yang dipersetujui.

Ini menyentak beliau kerana sebelum ini beliau tidak mengetahui langsung bahawa terdapat klausa pada kontrak yang menyatakan penyewa kedai perlu membayar baki sewa jika menarik diri sebelum tempoh sewa tamat.

Haji Kamal, 56 tahun, merupakan antara beberapa peniaga yang menghadapi masalah sedemikian.

Sepanjang tahun lalu sahaja, Pengarah Bahagian Komersial PropNex, Cik Aida Atan, menguruskan sekitar 72 kes peniaga Melayu yang menghadapi masalah serupa.

Mengongsi pengalaman beliau dengan Ekoniaga di restorannya, Rasa-Rasa Warisan, di Blok 925, Yishun Central 1, semalam, Haji Kamal berkata: 'Kebanyakan kita apabila mendapat kontrak sewa, hanya tahu menandatanganinya sahaja dan kurang memahami kandungan kontrak itu. Memang sukar sebab kontrak itu tebal. Tetapi kita patut faham betulbetul isi kandungan kontrak itu.'

Bukan itu sahaja, perkakas dapur yang dibelinya turut dirampas, serta bayaran ubah elok dan deposit gerai sebanyak $25,000 tidak dipulangkan. Deposit merupakan wang cagaran yang tidak akan dikembalikan jika penyewa gagal menepati perjanjian.

Klausa tersebut banyak terdapat dalam kontrak yang dibuat pusat makanan dan kedai komersial di Singapura, kata Cik Aida.

Dalam kes Haji Kamal, beliau cuba mendapatkan pengganti bagi menyewa gerainya itu tetapi tidak dibenarkan pemilik pusat makanan berkenaan.

Namun beliau bernasib baik kerana selepas berunding dengan pemilik pusat makanan itu, pemilik itu memberi kelonggaran agar Haji Kamal tidak perlu membayar baki sewa tetapi beliau mengambil deposit $25,000, perkakas dapur dan bayaran ubah elok bernilai sekitar $70,000.

'Ada peniaga yang tidak begitu bernasib baik seperti Haji Kamal. Sudahlah mereka mengalami kerugian akibat perniagaan lemah, mereka juga disaman oleh pemilik pusat makanan kerana tidak melunaskan baki bayaran sewa walaupun sudah tutup kedai. Ia bagai 'sudah jatuh ditimpa balak',' kata Cik Aida, yang akan menulis surat kepada pemilik pusat makanan itu untuk mendapatkan kelonggaran dalam pembayaran dan kebenaran untuk mencari pengganti bagi menyewa gerai itu.

Dalam kerancakan perniagaan ketika ini, ramai peniaga yang berminat untuk mendapatkan gerai di pusat makanan komersial perlu memahami akan kandungan kontrak sewa sebelum menandatangani kontrak itu, nasihat beliau.
